The highest court agreed last month to take up the case brought by Jatonya Muldrow, who appealed a lower court decision. That lower court ruled that Muldrow’s transfer, which she said was to an undesirable location so as to accommodate a male officer, could not be the basis of a discrimination lawsuit.
How the Supreme Court rules on Muldrow’s case can have implications for thousands of discrimination lawsuit filed every year where workers allege discrimination after their employers move them, including as a tactic to force them to resign. The court agreed to hear the case during its next term, which starts in October.
President Joe Biden’s administration in May urged the Supreme Court to hear the case arguing that lower court dismissals of cases such as in Muldrow’s are a misinterpretation of federal anti-discrimination laws.
