Manager in 'Intolerable' Workplace Awarded £60K

A manager won more than £60,000 after having to endure an "intolerable," work environment. So reports People Management.

The Cambridge Employment Tribunal ruled in favor of the manager in A. Fletcher v. Countrywide Estate Agents after determining that she was unfairly dismissed. The manager, A Fletcher, found herself in an "intolerable" work environment after her firm was bought by another firm.

Fletcher functioned well with the owner of Ashby Lowery, Darren Wilson, but things became bad when Countrywide Estate Agents bought the firm. Countywide human resources had "no or only minimal contact" with Ashby Lowery employees, and no training or demonstrations for the new operations systems, according to the judgement.

Wilson, now a Countywide employee, did not help resolve numerous problems that had cropped up and left it to Fletcher to deal with it all. Fletcher had to answer more than 700 complaint emails in four months and when she asked Wilson for help, "she was told, in effect, to deal with it," the judgement finds.

Barry Stanton, head of employment law at Boyes Turner, notes that "the failure to address the problems 'amounted to a substantial erosion of trust and confidence' from the employment relationship."

"This case demonstrates the importance of listening and dealing with complaints from members of staff," Stanton says. "Failing to deal with such complaints and concerns can permit employees to resign and claim that they have been unfairly--or wrongfully--constructively dismissed."
