Donald Trump released his executive order on Combating Race and Sex Stereotyping September 22 in part to “combat offensive and anti-American race and sex stereotyping and scapegoating…” The order, which impacts government agencies, Fortune 500 companies, educational institutions, nonprofits and others entities that tap federal contracts, or plan to, is not expected to survive once President-elect Joe Biden assumes office later this month.
Under President Trump, the Office of Federal Contract Compliance Programs had established a hotline for complaints pertaining to training materials. In the case, Santa Cruz Lesbian and Gay Community Center v. Donald J. Trump, however, the district court ruled that the executive order violated the First Amendment “because it impermissibly chills the exercise of the Plaintiffs’ constitutionally protected speech, based on the content and viewpoint of their speech.”
